Reduction of Bail:
In most cases, a person charged with a crime is entitled to be released on bail pending trial. Bail is a form of security that is paid to the court in exchange for the release of a person charged with a crime. It accompanies a pledge that the accused will attend all court hearings. The amount of bail is determined by the court based on the severity of the crime, the risk of flight, and the financial status of the defendant. In certain cases, the defendant may not be eligible for bail: A capital offense, a felony while he was free on bail awaiting trial on a previous felony, a felony while he was on probation or parole for a felony.
In most jurisdictions, bail may be posted in cash or by a written guarantee called a bail bond. The person who posts the bail bond is called a surety. Typically this is done through a Bail Bondsman or Bonding Company. Individuals can be sureties if they own real or personal property within the state with a net worth of at least the amount set in the order for bail. This type of bail usually requires a motion outlining who the individual sureties are, proof of property ownership and equity values. The court may or may not accept this type of bail.
Motion for OR Release:
In a motion for OR (own recognizance) release, the court is asked to permit an individual to be released from jail without bail, usually in exchange for a promise that he or she will appear in court when next required to do so. The Financial condition of the accused; address of the accused and his or her employment history; occupation, name and address of employer; family situation and history; prior criminal record and pertinent facts of the particular offense.
