Because of increased political pressure from various interest groups, the prosecution of domestic violence has taken a dramatic turn in the last number of years. No longer do the police have the discretion to handle complaints informally. Therefore, no matter how minor the complaint, if the police were called, or 911 was called, there is an extreme likelihood that an arrest will be made and that a formal prosecution will be started.
We handle cases involving allegations such as the following:
- Spousal abuse or abuse of a domestic partner
- Mutual battery
- Emotional abuse or intimidation
- Economic deprivation
- Sexual abuse
- Threats of violence or harassment
- Stalking
- Violations of domestic violence restraining orders (DVROs)
In
- A three year period of formal probation.
- Required attendance at a Domestic Violence Batterer's Class, which is a one year program. You are brought back to court from time to time to insure that you are actively participating.
- Inability to own a firearm for 10 years.
- A "Peaceful Contact" or "Stay Away" restraining order naming the alleged victim.
Restraining orders can be obtained upon the application of the complaining party without notice to the alleged offender, provided that a court date is set for hearing the other side of the story. We'll work closely with you to investigate the circumstances of the incident and make sure that your defense is presented as clearly and effectively as possible.
