· repetitive stress or repetitive strain injuries, also known as continuous trauma work injuries, such as carpal tunnel syndrome.

· chronic back pain which may occur in Offices work places.

If you have a work-related injury or industrial or workplace accident, and wonder if it should be covered by California Workers Comp insurance, we hope that you will find this site helpful in providing information. We are ready to serve you.

The following information may assist you in better understanding California Workers Compensation laws and the disability benefits, medical benefits, and vocational rehabilitation benefits to which you may be entitled, as well as awards or settlements for permanent partial disabilities or permanent work restrictions.

Generally speaking, California Workers Compensation is a state-regulated insurance system that pays medical bills and may replace lost income through temporary or permanent disability payments for California employees who are injured and / or disabled at work or who have work-related injuries, industrial diseases, or occupational illnesses.

Workman's Comp will pay for the medical treatment of injuries or illness if:

· the injury occurred at work or the disease or illness is job-related; and

· the injured worker is an employee and not an independent contractor who suffered an injury on the job site.

California Workers Compensation insurance will also replace some of the worker's lost wages or income if:

· the work injury or industrial illness caused the California injured worker to lose some or all income for more than three days.

Ask us about the specifics of your California Workman's Compensation case. California also has state disability benefits to which you may be entitled. California state disability insurance benefits may be used if there is a delay in Work Comp insurance payments.

An injured California worker is usually entitled to all reasonable medical care expenses that result from a work-related injury. Covered medical care by California Workers Compensation insurance claims generally include: medical, surgical and hospital services, dental services, crutches, hearing aids, chiropractic treatment, physical therapy, nursing care, etc and prescribed medications. Covered expenses typically continue as long as medical treatments are reasonable and necessary to cure the on the job injury.

Be sure to check with your Workers Comp attorney to determine if your employer has the right to choose his or her own medical provider for your care. Worker's Compensation injury claims and Workers Compensation injury benefits are subject to California laws that your employer might not inform you of. You have the right to take medical treatment control after 30 days and choose your own physicians.

Workman's Compensation claims may cover a variety of injuries ranging from temporary inability to work, to a permanent and total, or partial disability.

You may be entitled to payment for a partial impairment. Partial impairment is known as a partial incapacity that prevents an employee from competing in the work place as before. Medical evidence will determine the extent of your temporary as well as permanent disability. The value of your claim depends, in large part, on the extent of a permanent disability. We will be able to answer the hard injury settlement questions for you, and counsel you on:

· stipulation and award;

· compromise and release;

· the difference between temporary disability, permanent disability, partial permanent disability, and 100% disability.

· vocational rehabilitation (voc rehab)

· rights to future medical care, medical treatment and payments

You should also be aware that if you were dependent on your spouse for economic support, you may be entitled to death benefits from California Workmen's Compensation. Death benefits may be available for the employee's children if they were economically dependent on the deceased at the time of death.
